§ 3.85.145. Nonoccupational death benefits—Plans I and II.

  • A.

    When a member or a retired member dies from a nonoccupational cause, the beneficiaries of the member shall be eligible to receive retirement benefits equal to 50 percent of the member's gross monthly compensation.

    B.

    In the absence of a designation of beneficiaries on the form prescribed by the board, benefits shall be payable in the same manner as an occupational death benefit where no beneficiaries were designated.

    C.

    The manner of designation of beneficiaries shall be the same as the designation for occupational death benefits.

    D.

    No additional insurance or other compensation shall have any bearing on the payment of death benefits in this section.

    E.

    Benefits under this section shall be paid for any nonoccupational death occurring after February 29, 1972. The beneficiary of a member hired on or after July 1, 1977, who dies from a nonoccupational cause shall be entitled to the benefits in this section. The amount of those benefits shall not exceed 100 percent of the retiree's benefit while living.
