§ 3.85.135. Temporary non-occupational disability benefits—Plan III.

A.

A member is not eligible to receive nonoccupational disability benefits if the member's disability is due to elective surgery not required for the preservation of the member's health.

B.

A member receiving temporary non-occupational disability shall not receive such benefit if the medical authority returns the member to light duty and the member refuses to return to work.
