§ 3.85.125. Temporary non-occupational disability benefits—Plans I and II.

  • A.

    A member hired on or after July 1, 1977, is not eligible to receive nonoccupational disability benefits if the member's disability is due to elective surgery not required for the preservation of the member's health. Such surgery includes, but is not limited to, cosmetic surgery and voluntary sterilization techniques. This limitation does not include non-elective cosmetic surgery required to repair an injury received during the period when the member was employed by the municipality as a police officer or firefighter.

    B.

    A member receiving temporary non-occupational disability shall not receive such benefit if the medical authority returns the member to light duty and the member refuses to return to work.
