§ 19.20.010. General requirements and limitations.

  • A.

    As required by the Charter, assessments for capital improvements or public services within an assessment district shall be proportionate to the benefit received from and the burden imposed upon the improvement or service.

    B.

    An assessment district may be created or extended only with the approval of the property owners who would bear more than 50 percent of the estimated cost of the improvement or service. An assessment district may be initiated by:

    1.

    Petition of owners of property in the district; or

    2.

    The Assembly.

    C.

    This chapter governs the initiation and formation of assessment districts, and the confirmation, levying and collection of assessments for capital improvements and for services, except as provided otherwise in chapters 19.80 and 19.90, respectively, for sewer and water assessments levied upon connection.

    D.

    An assessment district for services may be created for a term of years or for an indefinite period, provided however, that each assessment district for services with definite term shall be dissolved or may be extended beyond the end of the specified term by the property owners who would bear more than 50 percent of the estimated cost of the service.

    E.

    Costs of administering and operating assessment districts shall be reviewed and adjusted annually, and shall be paid entirely from the district's assessment revenues, fees, grants or donations but not by either general or municipal tax revenues.

    F.

    More than one category of service may be provided in a single assessment district for services. Different categories of service may be of the same type of service provided at different levels. Each area within the district receiving a different category or categories of service from the district as whole shall be identified as a specific benefitted area within the service district. Property owners in each such specifically benefitted area shall be assessed for that benefitted area's proportionate share of the cost of providing the category or categories of service received.
