§ 16.55.025. Conflict between Alaska Child Care Licensing Statutes and Regulations and this chapter.

  • If there is a conflict or inconsistency between the Alaska Child Care Statutes and Regulations and this the provisions of this chapter, this chapter controls when it meets or exceeds the requirements of the Alaska Child Care Statutes and Regulations. Where provisions of the adopted Alaska Child Care Statutes and Regulations refer to another section of the state statutes or regulations that are not adopted, such reference shall be deemed to refer instead to the corresponding section of this chapter, unless there is no such corresponding section. After consultation with the municipal attorney, the director may declare a specific provision of this chapter does not meet or exceed the requirements of the Alaska Child Care Statutes and Regulations and direct by written policy that enforcement of said provision shall be suspended and the relevant Alaska Child Care Statutes and Regulations enforced in its place.
