§ 15.30.150. Air pollution inspections; right to entry.

    Subject to subsection B. of this section, the director may at any reasonable time, upon presentation of proper identification, and when granted permission by the owner or by some other person with apparent authority to act for the owner enter upon, investigate, and inspect any land, building, or premises where reasonable cause exists that there has been or is a violation of this chapter, or enter upon such land, building, or premises to perform a duty of the director under this chapter.

    B.

    When permission is refused or cannot be obtained, a search warrant may be obtained from a court of competent jurisdiction upon a showing of probable cause to believe that a violation of this chapter may exist. Such inspection may include administration of any necessary tests. An inspection warrant must state the name and address of the premises to be inspected, the authority to conduct the inspection, the nature and extent of the inspection, and the facts and circumstances justifying the inspection. Warrants issued under this section shall be returned within 30 days.
